Privacy Policy

Certify Data Systems, Inc. (“Certify”) respects your privacy and is committed to protecting the personal information you share with us. This statement (“Privacy Statement”) describes how Certify collects and uses your personal information when you use our site or when you otherwise choose to provide us with your personal information.

By submitting Personal Information through our website or related services, you agree to the terms of this Privacy Statement and you expressly consent to the processing of your Personal Information in accordance with this Privacy Statement.

Children
We do not intentionally gather Personal Information about visitors who are under the age of 13.

Users Outside of the United States
Your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be less stringent than the laws in your country. 

Types of Information
We collect Personal Information and Anonymous Information from you when you visit our site or when you send us information or communications.  “Personal Information” means any information that may be used to identify an individual, including, but not limited to, a first and last name, email address, physical address, phone number, other contact information and any other non-public information associated or linked with the foregoing, for example, title, occupation, and industry.  “Anonymous Information” means information that is not associated with or linked to your Personal Information; Anonymous Information does not permit the identification of individual persons.

Information Collection
Certify may collect Personal Information, such as your name, email address, mailing address, phone number, and company, when you register for an account on the website, when you contact us using the form on our website, or when you submit your Personal Information to Certify for any other reason. When you post messages on the message boards of our website, the Personal Information contained in your posting will be stored on our servers and other users will be able to see it.  From time to time, Certify may receive Personal Information from third parties with whom we have contractual relationships, such as our business partners and vendors. We may add this information to the Personal Information we have already collected from you via our website.

When you browse our website without logging in , you do so anonymously. When you browse our website with or without logging in, we may log certain Anonymous Information that your browser sends us, such as your IP address, browser type and language, access time, and referring Web site addresses, including domain name. We may also collect information about the pages you view within our sites and other actions you take while visiting us. Collecting information in this manner allows us to collect statistics about our website’s usage and effectiveness and improve the content of our website.

Access to certain Certify web pages may require a login and a password. The use of those web pages, and the information downloadable from those web pages, may be additionally governed by a written agreement between your employer and Certify. Your Personal Information may be retained by Certify to verify compliance with the agreement.  Please contact your employer to better understand the terms and conditions governing your use of such web pages.

Cookies and Other Tracking Technologies
Like many other commercial websites, the Certify website may use standard technologies, such as “cookies”, web beacons, or other similar technologies, to collect information about how you use the site or to record that you opened an email marketing message. A cookie is a small data file that certain websites write to your computer’s hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you have visited. A cookie cannot read data off your hard disk or read cookie files created by other sites. Some parts of Certify's website may use cookies to track user traffic patterns. We do this in order to determine the usefulness of our website information to our users and to see how effective our navigational structure is in helping users reach that information.

Some Certify webpages and HTML-formatted e-mail newsletters may use web beacons in conjunction with cookies to understand user behavior. Web beacons can recognize certain types of information on a visitor's computer, such as a visitor's cookie number, time and date of a page view, and a description of the page where the web beacon is placed. Some Web beacons may be unusable if you elect to reject their associated cookies. Certify may also use customized links or other similar technologies to track email links that you click. We may associate that information with your Personal Information in order to provide you more focused e-mail communications or purchase information. You may indicate a preference to stop further delivery of that type of communication as set forth below.

If you prefer not to receive cookies while browsing our website or via HTML-formatted emails, you can set your browser to disable cookies, although some areas of Certify's website may not work properly if you do so.

How We Use Information Collected
Certify uses Personal Information for several purposes: to facilitate the creation of and secure your account on our website; to validate and fulfill your requests for certain products and services; to personalize your experience on our website; to send you the latest company announcements, software updates, special offers or other information we think you would like to hear about from us; to better understand your needs and provide you with better services; to respond to your inquiries related to employment opportunities or other requests; and to make telephone calls to you, from time to time, in response to your inquiries. We may also use your information to send you direct marketing information, contact you for market research, or have a regional representative contact you.

Marketing
We may use the Personal Information you provide to Certify, as well as the information we have collected about you indirectly, for our marketing purposes. You may at any time choose not to receive further marketing materials from us by following the procedures set forth below. 

Recruitment
In connection with a job application or inquiry, whether advertised on an Certify Web site or otherwise, you may provide us with Personal Information, such as a resume. We may use this information to address your inquiry or consider you for employment purposes. Unless you tell us not to do so, we may keep the information for future consideration.

Creation of Anonymous Information
We may create Anonymous Information records from Personal Information by excluding information (such as your name) that make the data personally identifiable to you.  We use this Anonymous Information to analyze request and usage patterns so that we may enhance the content of our website and improve site navigation.  Certify reserves the right to use and disclose Anonymous Information to third party companies in its discretion.

Feedback
If you provide feedback on our website or any of our products or related services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Information.  Company will collect any information contained in such communication and will treat the Personal Information in such communication in accordance with this Privacy Statement.

Affiliates / Acquisition
Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future.  We may share some or all of your Personal Information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Statement.  If another company acquires our company or our assets, that company will possess the Personal Information collected by it and us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Statement.

Disclosure to Third Party Service Providers
Except as otherwise stated in this policy, we do not disclose the Personal Information collected from our services to other entities.  However, we may share your Personal Information with third party service providers to provide specific services, such as to provide you with company announcements, software updates, special offers or other information we think you would like to hear about or to conduct market research.  These third party service providers are required not to use your Personal Information other than to provide the services requested by Certify.  You expressly consent to the sharing of your Personal Information with our contractors and other service providers for the sole purpose of performing such services.

Other Disclosures
Regardless of any choices you make regarding your Personal Information (as described below), we may disclose Personal Information in connection with any legal investigation and/or if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on Certify; or (b) protect or defend the rights or property of Certify or users of our products, website or related services.

Your Choices Regarding Your Personal Information
We offer you choices regarding the collection, use, and sharing of your Personal Information.  When you receive newsletters or marketing communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions included in each e-mail you may receive, by indicating so when we call you, or by contacting us directly (see contact information below.) Despite your indicated e-mail preferences, we may send you notices of any updates to our Privacy Statement.

Changes to Personal Information
You may change any of your Personal Information in your account by sending an e-mail to us at the e-mail address set forth below.  You may request deletion of your Personal Information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).  When we delete any information, it will be deleted from the active database, but may remain in our archives.

Data Security
Your Certify account information is password-protected for your privacy and security. Certify uses a variety of industry-standard physical and electronic security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure, such as policies restricting access to data to authorized personnel, industry-standard encryption to enhance the security of sensitive data transmissions, and physical safeguards to protect data stored in electronic form. We also require you to enter a password to access your account information.  Please do not disclose your account password to unauthorized people.  Repeated attempts to access your account information with the incorrect password may result in your account being locked out.  If your account has been locked out, please contact us at the telephone number listed below to verify your identity and re-enable your account.  While we strive to protect your Personal Information, we cannot ensure the security of the information you transmit to us, and so we urge you to take every precaution to protect your Personal Information when you are on the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser.

Third-party Sites
Our website may contain links to websites operated by other companies.  Some of these third-party sites may be co-branded with a Certify logo, even though they are not operated or maintained by Certify.  Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents.  When you click on such a link, you will leave our site and go to another site.  During this process, another entity may collect Personal Information or Anonymous Information from you.  We have no control over, do not review, and cannot be responsible for, these outside websites or their content.  Once you have left our website, you should check the applicable privacy statement of the third party website to determine how they will handle any information they collect from you.

Changes to this Privacy Statement
Certify may amend this Privacy Statement from time to time. If we make any substantial changes in the way we use your Personal Information we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our website.  Any material changes to this Privacy Statement will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our site.  These changes will be effective immediately for new users of our website or related services.  Please note that at all times you are responsible for updating your Personal Information to provide us with your most current e-mail address.  In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice.  In any event, changes to this Privacy Statement may affect our use of Personal Information that you provided us prior to our notification to you of the changes.  If you do not wish to permit changes in our use of your Personal Information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us.  Continued use of our website or related services, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
